All services are subject to availability and our internal approval process.

We reserve the right to refuse or discontinue services at our discretion.

Digital Web Solutions provides, but is not limited to, the following services:

~CMS-based website development using the Zip360 platform

~Responsive and mobile-friendly website builds

~Website redesign and revamps

~Website maintenance and management

~Website hosting, domain, and CMS management

~Digital consulting and related services

All services are provided based on the selected package, written agreement, or approved quotation.

3. Access to This Site

We aim to ensure uninterrupted availability of our website, however:

~ We do not guarantee continuous, error-free access.

~ Access may be temporarily suspended for maintenance, upgrades, or technical issues.

~ We are not responsible for any disruption or loss resulting from inability to access the site.

4. Third-Party Websites

Our website may contain links to third-party sites for user convenience.

~ Does not control or endorse third-party content or services.

~ Is not responsible for any loss, damages, or actions arising

only once the full agreed payment has been received.

~ Until full settlement, all work remains property of Digital Web Solutions.

The name Digital Web Solutions, associated logos, and brand identifiers are trademarks.
They may not be used in connection with any goods or services without written consent.

7. User Responsibilities

Users of this website and our services agree to:

~ Provide accurate and truthful information when contacting us or placing orders.

~ Not engage in unlawful or abusive behaviour, including hacking, data theft, or

interference with site functionality.


Any violation may result in restricted access or legal action.

8. Pricing, Quotes & Payments

All prices and quotations are valid for a limited time only

Prices may change without notice. A deposit or full payment is required before work begins.

Final delivery may be withheld until full payment is received. Non-payment may result in:

~Work suspension

~Website access restriction

~Hosting suspension

Legal recovery action if necessary

9. Refunds & Cancellations

Due to the customised nature of our services, all payments are non-refundable unless agreed in writing.
If a client cancels a project after work has begun, the payment made up to that

point will cover the work completed and is non-refundable.

10. Project Timelines

Estimated delivery dates are provided in good faith but are not guaranteed.

Delays may occur due to:

~ Client content delays

~ Third-party integrations

~ Technical complications


Digital Web Solutions is not liable for delays caused by factors outside our control.

11. Disclaimer

All information and services are provided “as is” and “as available”.
We do not guarantee that:

~ Services will meet your expectations

~ Websites will be error-free or uninterrupted

~ Third-party plugins, integrations, or hosting

platforms will function indefinitely

12. Limitation of Liability

Digital Web Solutions, its owners, and employees will not be liable for:

~ Loss of data or revenue

~ Website downtime or security breaches caused by third-party platforms

~ Losses arising from client misuse, hosting provider issues,

plugin failures, or external cyber-attacks.

Our maximum liability under any circumstance will not exceed the

amount paid by the client for the relevant project.

13. Security & Data Protection

We take reasonable measures to protect client information. However, no online

transmission is completely secure.
Clients are responsible for safeguarding their login details and website credentials.

14. Amendments to These Terms

Digital Web Solutions may modify these Terms & Conditions

at any time without prior notice.
Continued use of the website or services after updates

constitutes acceptance of the revised terms.

15. Website Design & Development Scope

Website design includes the creation of the website layout, structure, and overall appearance.

Website development includes building the website using the Zip360 Content Management System (CMS), configuring pages, functionality, and custom code where required.

Unless explicitly stated:

~Content writing, logo design, branding, photography, or marketing services are not included

~Only features listed in the selected package or quotation are included

~Any request outside the agreed scope is considered an additional service

16. Website Redesigns

Website redesign services apply to:

Existing websites built by Digital Web Solutions, or Websites built by third parties

Redesigns may include layout changes, visual updates, mobile optimisation, or structural improvements. Pricing is based on complexity and size and is quoted separately.

17. Hosting & CMS Management

If hosting is purchased through Digital Web Solutions, the following applies:

Hosting includes:

~Website hosting via the Zip360 CMS platform

~CMS access and platform management

~Basic uptime monitoring

Hosting does not include:

~Unlimited storage

~Guaranteed uptime

~Email hosting (unless stated)

~Ongoing content updates

Hosting is billed monthly and must remain active for the website to stay online.

Failure to pay hosting fees may result in website suspension or removal.

18. Website Maintenance (Monthly Service)

Maintenance services include:

~Website backups

~Security monitoring

~Performance checks

~General upkeep to ensure the website remains functional and accessible

Maintenance does not include:

~Adding new pages

~Uploading new content

~Design changes

~Feature additions

~SEO changes beyond initial setup

Maintenance is optional unless stated otherwise and is billed monthly.

19. Content Updates & Additional Add-Ons

Once a website has been completed and delivered, any additional work is charged separately, including but not limited to:

~Adding or editing content

~Uploading images or galleries

~Creating new pages or sections

~Design changes or layout updates

~Adding new features, forms, popups, or integrations

Pricing for add-ons is quoted per request or covered under an active maintenance plan if applicable.

20. Client Responsibilities

Clients agree to:

~Provide all required content, information, and approvals on time

~Ensure content supplied is accurate and lawful

~Review and approve work within reasonable timeframes

Delays caused by missing content or approvals may delay project completion.

21. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

If any provision is found unenforceable, the remaining provisions remain valid.
